Are electronic signatures legal in India?

India's Information Technology Act 2000 (Section 5) recognizes electronic signatures as legally valid where a rule requires a signature. The IT (Amendment) Act 2008 expanded the framework. Indian law specifically recognizes two methods: a digital signature using an asymmetric cryptosystem and hash function (issued by a Certifying Authority under the IT Act), and the Aadhaar-based e-KYC electronic signature. Simple electronic signatures without these technical requirements are in a greyer area under Indian law.

- Section 5 of the IT Act grants electronic signatures the same legal recognition as handwritten signatures for most purposes.
- For the strongest protection under Indian law, use a digital signature certificate (DSC) issued by a licensed Certifying Authority, or Aadhaar-based eSign.
- The Indian Contract Act 1872 requires offer, acceptance, consideration, and capacity. An electronically signed contract can satisfy these requirements.
- Companies Act 2013 requires certain filings to use DSC for MCA portal submissions.
